As a result, effectively squatting and even putting up a “No Trespassing” sign. Farzana Rahman is a single parent relying on the rental income to support her son’s college education. Now she faces a legal battle to reclaim her home.
The trouble began when Rahman’s guests booked a long-term stay from October 25 to May 24. However, they refused to leave after their reservation ended. Upon sending her cleaning lady to prepare the property for the next renter, Rahman discovered the guests were still occupying the home and unwilling to leave.
“They answered the door and said, ‘No, we haven’t moved out,’” Rahman told local news.
When she went to the property with police, the guests promised to leave the next morning. Instead, they put up a handwritten sign declaring their intent to stay until a formal eviction order was processed. Thus, claiming legal residency.
Rahman, struggling with the situation, contacted Airbnb, which provided minimal assistance.
“They told me to seek legal help and ensure my safety,” Rahman said.
Despite reaching out to Airbnb multiple times, responses were lacking. As a result, leaving Rahman in a frustrating limbo.
Legal experts warn that tenants staying over 90 days can gain significant legal rights. Maya Davis, an attorney from The Law Offices of James Scott Farrin, advised immediate action in such cases.
“You may need to file a summary ejectment through the court,” she said.
Thus, explaining the process of legally evicting someone who refuses to leave.
The incident has prompted a broader discussion about the complexities of long-term Airbnb rentals and the legal challenges hosts may face. Rahman has filed eviction paperwork, with a court date set for the week of June 13.
